Leveraging Review Managers in Urgent Trade Secret Litigation

Faced with a court imposed deadline to review and produce nearly 20,000 documents for a trade secret misappropriation matter on a tight budget, our client knew they would not be able to manually review all of the documents. The challenge intensified when additional data was identified after the initial review population had already been nearly completed.

The new data nearly doubled the review population and needed to be processed, reviewed, and produced in a three-day period over a holiday weekend.

Our Solution: Identifying Privileged Populations

Our Review Managers identified populations that were likely Not Relevant then targeted sets for privilege and other issues on the matter. Comfortable with our grasp of the issues and tagging, our client agreed with opposing to produce all documents – including NR documents under confidentiality restriction – as a show of good faith.

The new data was brought to our attention Thursday evening before the holiday weekend. We quickly set a plan to process and load the data for review, coordinating our overnight resources and mobilizing on the request.

Before the day began on Friday, the data was staged and ready for our team to assess and prioritize for review. We used a combination of search term targeting, privilege screens, and historic similar data to identify a smaller subset that needed manual review while the remainder could be tagged without eyes-on coding.

The Results: Rapid Resolution

By Sunday afternoon, the production set was delivered to the client for final QC in advance of the Monday delivery deadline. In total, over 15,000 documents were processed, reviewed and identified for production from the supplemental collection in less than 48 hours.

Over 30,000 documents were produced and all while staying within the original budget provided to the client.
